ProductionHeads Membership Terms & Conditions
Rules. It's a love hate relationship. On the one hand they feel limiting, but on thÂe other, it's always good to define boundaries. So before we embark on the journey to membership, here are a few things you should know about us.
1. Application
1.1 Paid Membership registration is available online at ProductionHeads.com for an annual fee. During the application process you will be required to provide ProductionHeads with personal information to create your account. Members are responsible for ensuring their information is up to date and accurate. Anyone not using their true identity may have their membership terminated without notice or refund.
2. Membership Fees
2.1 ProductionHeads Paid memberships are available on an annual basis. Our Basic memberships are also available on an annual basis and are not subject to fees.
2.2 Payment is made by credit card online through our pay service provider Caledon Card Services. This service is operated in Canada by Production Heads Network Inc.("ProductionHeads, ProductionHeads.com" or "we"), a company incorporated in British Columbia.
Payment can be made only by credit card via the website after completion of all the registration details.
2.3 ProductionHeads may increase the annual fee periodically to account for rising operational costs. If we do, we'll let you know either by posting the new rate on the Website or by emailing members directly. In no way will any increase in membership fees affect currently active accounts.
2.4 Paid Membership fees are based on a one year term. Productions Heads Network Inc. offers no full nor partial refunds at any time regardless of cancellation or termination.
2.5 Members will receive email notifications of their account status 30 days prior to their renewal date. If payment is not received by the due date, your profile will be removed from the site. Please note that newsletter subscriptions and member profiles are managed separately. Cancellation of one does not necessitate cancellation of the other.
2.6 ProductionHeads will not retain previous payment information nor automatically renew Paid memberships. Renewed Paid memberships are effective on the last day of the previous Paid membership.
3. Content of Postings
3.1 You may not post anything on ProductionHeads that contains any offensive language or anything which is considered by us to be obscene, threatening, harassing, defamatory or otherwise unlawful.
3.2 Any use of ProductionHeads for any illegal or unlawful purpose, including posting anything that infringes on the rights of any other persons is just cause for an immediate termination of your account without warning or refund. Same goes for any claim that you are anyone other than your true self, or any claim that you represent any company or organization that in truth you do not. Seriously.
4. Intellectual Property Rights
4.1 ProductionHeads owns all intellectual property rights to the Website and any reproduction, distribution or publication of any content is prohibited without our express written consent, excluding the contents of your member profile. You can request our consent by emailing us at info[at]productionheads.com.
4.2 When you post to ProductionHeads.com, you agree to allow us to publish and reproduce its contents in any capacity we choose. This excludes any information, audio, video & image files posted in your membership profile.
5. Our Commitment To You
5.1 ProductionHeads makes all reasonable efforts to maintain the website in a fully operational condition throughout the term of your membership, but we cannot guarantee continued, uninterrupted or errror-free operation of the service.
5.2 ProductionHeads provides its members with access to archives of all previous newsletters & contracts.
5.3 Newsletters will be sent to our subscribers once monthly although we cannot guarantee newsletters will be sent or received at any particular time on any particular day.
6. Liability and Indemnity
6.1 ProductionHeads makes every effort to ensure member postings are non-offensive and upholding of all applicable laws, however, we do not accept any liability for any posting created by a member. We do not guarantee the accuracy of any postings that appear on ProductionHeads.com. Members are cautioned to use discretion when communicating with other members and potential employers they were connected to through ProductionHeads.com. We ask all members to notify ProductionHeads of any misuse of the site such as misrepresentation, misinformation or any other fraudulent activity.
6.2 ProductionHeads does not offer warranties of any kind, either express or implied. ProductionHeads the company, it's staff or any other persons otherwise involved in Production Heads Network Inc. is not liable for any damages arising out of the use of the service, or the inability of any person to use the service.
6.3 You are responsible for the content posted by you (or by any person accessing your account), and you agree to indemnify Production Heads Network Inc. and it's affiliates and hold it harmless in respect of any losses, expenses, damages and costs, including any legal fees, resulting from: (1) any breach by you of these Terms and Conditions; (2) any infringement of copyright or intellectual property rights in material posted by you; or (3) any other wrongful use by any ProductionHeads member.
7. Termination
7.1 ProductionHeads reserves the right to terminate, suspend, restrict, or attach conditions to your membership and access to the website if you are in breach of these Terms and Conditions, entirely at our own discretion. We reserve the right to deny access and membership to any member for any reason that we consider appropriate.
7.2 In the event of termination (or suspension or restriction) for being in breach of these Terms and Conditions, no refunds will be payable.
7.3 Should you choose to terminate or cancel your membership, no refunds will be payable.
8. Personal Information
8.1 We respect the privacy of your personal information in accordance with our Privacy Policy.
9. Member Conduct
9.1 If you are involved in any way in exploiting website resources such as member contact information for the purpose of transmitting unsolicited email in any form either through the website or to any ProductionHeads member, your membership will be terminated immediately.
9.2 Members agree to discontinue any communication with any other member at their request. Refusal to do so will be considered harassment, against membership terms and as such grounds for membership termination.
9.3 Discrimination against any persons, in any form whatsoever is not tolerated and is subject to membership termination without refund as is any other offensive or abusive communication or behaviour towards other members.
10. In General
10.1 In the event that the website displays or advertises promotions, services or products which are offered by third parties or other individual members and you take advantage of such offers, any contractual relationship that may result is between you and the third party.
10.2 ProductionHeads may modify these Terms and Conditions at any time. In such an event, we will notify members either by email or Latest News posting. If any of these terms is found to be invalid or unenforceable, the remainder of the terms shall continue in full force and effect.
10.3 You cannot assign your membership without our agreement.
10.4 These Terms and Conditions, and your use of the website and the ProductionHeads service are governed by federal & provincial laws in Canada and you and in the event of any dispute arising out of or related to your ProductionHeads membership, you agree to submit to the jurisdiction of the courts of Canada and British Columbia.
